Garrett Consultants LLC – Sales Policy
1. Payment Terms
All checks for deposits, progress payments, and final payments, along with any official documents, should be made payable to Garrett Consultants LLC and sent to the following address:

Payment is due immediately upon invoicing. Any unpaid balance beyond 30 days will accrue 1.5% simple interest per month.
Preferred Payment Method: Checks (No convenience fees).
Returned Checks: Any uncashable or bad checks will incur a $40 fee.
Credit Card Payments: Available upon request; a 4% convenience fee applies.
ACH Payments: Available upon request; a 1.5% convenience fee applies.
Any discounts or special offers may be revoked if payment is not received by the due date.
2. Order & Quotation Terms
Quotes/Estimates: All quotes are valid for 30 days from the issue date unless otherwise stated.
Order Changes: Any modifications to an order after placement may be subject to additional costs and lead time adjustments.
Cancellations: Orders canceled after processing may incur restocking or cancellation fees.
3. Shipping & Delivery
Shipping Costs: Customers are responsible for all shipping and handling charges unless otherwise specified.
Delivery Timelines: Estimated delivery dates are not guaranteed and are subject to availability and carrier delays.
Inspection Upon Delivery: Customers must inspect shipments upon receipt and report any damages or discrepancies within 2 days.
4. Warranty Policy
Retail Sales: No additional warranty is provided beyond the manufacturer’s warranty. Customers must contact the manufacturer for any warranty claims.
Installed Systems: A 3-month labor warranty is provided from the completion date of installation. Hardware failures are covered under the manufacturer’s warranty.
5. Return Policy
Restocking Fee: All returns are subject to a 30% restocking fee plus the cost of return shipping.
Non-Returnable Items: Custom or special-order items not typically stocked, shipping costs, and any associated labor costs are non-refundable.
Return Window: Returns must be made within 15 calendar days of receiving the item.
6. Sales Tax Responsibility
If sales tax is not included in your invoice and you are not tax-exempt, Garrett Consultants LLC does not hold economic nexus in your state. It is your responsibility to report and pay all applicable state and local sales taxes in accordance with your local laws.
Please forward all tax exemption certificates where applicable to your sales representative.
7. Liability & Limitations
Service Limitations: Garrett Consultants LLC is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use any purchased products or services.
Data Responsibility: Clients are responsible for backing up data before any service or repair. Garrett Consultants is not liable for data loss.
8. Support & Maintenance
Post-Installation Support: After the 3-month labor warranty, additional support is available through hourly rates or service contracts.
Remote & On-Site Support: Emergency or after-hours support may be subject to additional fees.
9. Unsafe Work Conditions
Garrett Consultants LLC reserves the right to immediately halt all work if the worksite is deemed unsafe due to environmental hazards, including but not limited to:
Toxic substances (e.g., asbestos, mold, chemical exposure)
Poor air quality
Structural instability
Fire hazards
Any other dangerous conditions that pose a risk to health and safety
Work will resume only after the site has been deemed safe by a certified professional and all necessary safety measures have been implemented. The client is responsible for any additional costs or delays resulting from an unsafe work environment.
10. Dispute Resolution
Governing Law: Any disputes will be governed by the laws of Florida in the city of Orlando.
Resolution Process: Disputes must first be addressed through mediation before legal action is pursued.
11. Force Majeure Clause
Garrett Consultants LLC is not liable for delays or failure to perform due to causes beyond our control, including but not limited to:
Natural disasters
State of Emergency
Supply chain disruptions
Governmental actions
Labor strikes
Power or internet outages
12. Cloud Services & Data Recovery Policy
Cloud Responsibility: Clients are responsible for ensuring cloud data is backed up prior to any system changes.
Data Recovery Fees: Additional charges may apply for data recovery services due to client error.
Downtime Disclaimer: Garrett Consultants is not responsible for downtime caused by third-party cloud service providers (e.g., AWS, Azure, Google Workspace, Microsoft 365).
Third Policy Policy’s: Client is bound by any third party terms of service or Terms of use policy’s.
13. Intellectual Property & Work Product Rights
Garrett Consultants owns all intellectual property rights of any custom code or programming written for a project.
A non-exclusive license is granted to the client for use of the code unless otherwise agreed upon in writing.
No additional licensing fees apply unless explicitly stated in a separate agreement or noted on invoice.
14. Emergency & After-Hours Support Policy
After-Hours Emergency Rates: Additional fees apply for nights/weekends (2x standard rates unless stated otherwise).
Emergency After hours Fees: An Additional fee of $300 will be charged for any Emergency After hours calls
Emergency Definition: An emergency is defined as a critical system failure that disrupts business operations.
Response Times: Garrett Consultants will provide emergency support based on service agreement terms.
These policies are subject to change. By engaging with Garrett Consultants, clients agree to abide by these terms and conditions.
